Common Reasons for Refusal of a Temporary Residence Permit in Poland

Documents that are missing or incorrectly

When applying for a temporary residence permit in Poland, there are necessary documents that you must submit together with the application form. If you submit any of these required documents incomplete or incorrectly, you will most likely receive a negative decision on temporary residence permit from Immigration Office.  For this reason, you should make sure that all documents are complete and correct when applying for a residence permit.

No strong reason to stay in Poland

You should apply for a temporary residence permit if you wish to stay in Poland for a period exceeding 3 months. If you do not have a valid reason to stay in Poland for more than 3 months, your application for residence will be rejected. For example, students in their final semester wish to apply for TRC but are denied owing to their short study duration. Employees whose contracts are about to end are in the same situation.

Illegal stay at the time of application

It indicates that you submitted a TRC application while in Poland illegally. It happens frequently when people receive a rejection, file an appeal, and then apply again after a period of time without checking if the previous case is still active. They may fall into a trap if they submit a new case based on an existing one that has already been resolved.

Police couldn’t check your place of living

It indicates they couldn’t find your address in their database. It’s possible that you mentioned the incorrect postal code. It can actually pose complications because the immigration office is so overburdened that they don’t have much time to invite people for an address change. You must take care of yourself.

University or Employer is blacklisted

It means your application is linked to them, and they are currently stuck in the system, unable to be accepted by the Immigration Office. The government may issue orders to inspect educational institutions’ licensing on occasion. Universities that do not renew their licenses on time endangering their pupils.

How should I sumbit all the appeal documents?

Address the envelope to the below address:

Mazowiecki Urząd Wojewódzki w Warszawie
Wydział Spraw Cudzoziemców
Marszałkowska 3/5
00-624 Warszaw

How long does it take to get an answer regarding the appeal?

It very much depends on a type of TRC. People can normally wait from 3 months and till…infinity There are some of people are waiting for the final decision since 2016. The chance of positive decision after appeal is 100 times higher after appeal process.

Your status portal will not be working till final decision will be issued. You will get it by post and sms about card collection will come to you or your lawyer. Just take care very precisely about documents which were the reason of refusal. Submit all, better 2 times. Call them and ask if they have received the documents after 1 month from the appeal day.
